New Start Samsung Can Be Winner When It Regains Poplar Trust The court's surprisingly lenient ruling on former Samsung Group Chairman Lee Kun-hee actually astonished few people, probably including Lee himself. It was just the extension of a series of light punishments the nation's judiciary branch has meted out to the heads of family-controlled conglomerates, including Hyundai Motor, SK, Hanwha and Doosan. And the judges did so under the invariable pretext of "minimizing the impact" on the national economy. Even without the noisy denouncement by critics of the chaebol system that the judicial leniency runs counter to "the law of popular sentiment," the people are not so naive as to buy the judges' decisions at face value. At the same time, however, it cannot be denied that most Koreans, albeif feeling increasingly vexed with glaring irregularities and white-collar crimes committed by chaebol, seem uncertain how much pressure they actually want to put on the troublemakers-cum-industrial pillars, as a foreign journalist put it. In a decades-old lㅐve-hate relationship between them, the former appears to still dominate many Koreans. In other words, they think chaebol's contributions to the national economy offset the harm they have done to it - at least so far. The 66-year-old tycoon must be aware of this: In court, Lee said with tearful eyes, " You cannot make another company like Samsung Electronics, which produces 11 of the world's No. 1 brands, in a decade or two." In a final statement, he also said, "I have neglected putting affairs surrounding me in order, engrossed in moving ahead and competing with global companies. If few Koreans thought Lee would actually serve jail time, it would be because of his image as more of an industrial hero than a convicted businessman, as well as Lee's all-star defense counsels. Such good day a may be numbered, however, as the domestic consumers are becoming gradually intolerant of opaque business management and outdated corporate governance. Lee and Samsung in which the retired chairman is still the largest shareholder, ought to set about what he said as taking "moral" responsibility, now that he will likely be absolved from "legal" responsibility at the appeals court, too. The nation's largest conglomerate should listen to the criticism that Wednesday's ruling would considerably delay the process of reforming chaebol and sharply push up the cost for the national economy. This is the time for Lee, one of the most recognized industrialists not just in Korea but in the world, to turn his business acumen to upgrading the group's and the nation's corporate culture. Lee should instead take the lead in Samsung's rebirth as a business group with the most transparent and advanced management and governance to keep his promise of making a "globally respected company." not just in industrial might but in corporate reputation. Although he took one step back from the business forefront, Lee will have lots of work to do. The first and foremost will be to restore popular confidence in the business empire, which grew from $17 billion to $160 billion during his reign of just two decades. 새 출발 삼성은 대중의 신뢰를 회복할 때 승자가 될 수 있다. 이건희 삼성그룹 전 회장에 대한 놀라울만큼 관대한 법원의 판결에 대해 놀란 사람은 아마도 이 전회장을 포함해서 거의 없었다. 이는 우리 사법부가 현대자동차, SK, 한화 및 두산그룹 등 가족 지배 기업군들의 총수들에게 부과해 온 일련의 경미한 처벌의 연장선 상에 있을 뿐이다. 그리고 판사들은 예외 없이 국가 경제에 대한 “충격의 최소화”라는 명분 하에 그렇게 해왔다. 재벌 체제의 비판자들이 이런 사법부의 관대함이 “국민 정서법”에 반하는 것이라고 요란하게 비난하지 않더라도 법관들의 판결문을 액면 그대로 받아들일 만큼 국민들은 순진하지 않다. 그러나 동시에 대부분의 한국민들이 재벌이 저지르는 명백한 부조리나 화이트 칼라 범죄에 대해 점점 더 분노를 느끼면서도 어느 외국 기자가 말했듯이 아직 이 말썽꾼이면서도 산업의 기둥 역할을 하고 있는 재벌들에게 어느 정도의 압력을 가해야 하는지에 대한 확신이 서지 않고 있다는 사실도 부인하기 힘들다. 수 십년 간의 애증관계에서 전자쪽이 아직 다수의 한국인들을 지배하고 있는 것 같다. 바꿔 말하면 한국인들은 최소한 지금까지는 재벌의 국가 경제에 대한 기여가 그들이 끼친 해악을 상쇄하고 있다고 생각하고 있다. 66세의 이 회장도 이를 알고 있음이 틀림없는 것이 그는 법정에서 “세계 1위의 제품을 11개나 생산하는 삼성전자 같은 회사를 다시 만들려면 10년이나 20년 가지고는 안 된다”고 말했다. 최후 진술에서도 그는 “앞으로 나아가기만 하고 세계적인 기업들과 경쟁하는 데만 몰두한 나머지 주변일을 소홀히 했다”고 말했다. 이 전 회장이 실형을 살 것으로 생각한 한국인들이 거의 없었다면 이는 그가 고용한 최고 수준의 변호사 진용 뿐만 아니라 아직은 유죄선고를 받은 기업인 이라기보다는 이렇듯 산업 영웅으로서의 이미지가 더 강했기 때문이었을 것이다. 그러나 국내 소비자들이 점점 불투명한 기업 경영과 낡은 기업 지배구조에 대한 관용을 잃어감에 따라 이런 좋은 날도 머지 않아 끝날 지 모른다. 이 전 회장이 상급심에서도 “법적”책임으로부터는 면제될 듯 하므로 이 전회장과 아직도 그가 최대 주주인 삼성 그룹은 자신이 말한 “도의적”책임을 지는 일에 착수해야 한다. 국내 최대 재벌인 삼성은 수요일의 판결이 재벌 개혁 과정을 상당히 지연시키고 국가 경제에 대한 비용도 대폭 증가시켰다는 비판을 경청해야 한다. 한국 뿐 아니라 세계적으로 가장 인정받는 기업인들 중의 한 사람인 이 전 회장은 이제 사업 능력을 자신의 기업과 우리 나라의 기업 문화를 향상시키는 쪽으로 전환해야 할 때이다. 비록 이 전 회장이 아들에 대한 불법의혹이 있는 경영권 승계의 혐의로부터는 자유로워졌지만 이를 다시 시도할 것이 아니라 전문 경영인과 주주들에게 맡기는 것이 좋을 것이다. 대신 이 전 회장은 삼성이 가장 투명하고 선진화된 경영과 지배구조를 가진 기업으로 다시 태어나도 앞장 섬으로써 산업의 파워에서 뿐 만 아니라 기업적 명성면에서도 “세계적으로 존경받는 ” 회사로 만들겠다는 자신의 약속을 지켜야 한다. 비록 사업 일선에서는 한 발자국 물러났지만 이 전 회장의 할 일은 많을 것이다. 그 첫째이자 가장 중요한 일은 불과 20년 간이라는 자신의 재임 중 연간 매출이 17조원에서 160조원으로 늘어난 기업 제국에 대한 대중의 신회를 회복하는 것이다.
